An adoption creates a legal parent and child relationship between someone who is not the child’s biological parent and the child. During this process, the child’s biological parent’s rights and responsibilities are terminated. There are different types of adoptions:

Independent adoption

An independent adoption is where the birth parents place the baby with the adoptive parents. This generally happens shortly after the birth of the child, but older children can also be adopted through this process, if a guardianship does not fit the circumstances.

Stepparent or Second Parent adoption

Stepparent adoption is when spouse of the child’s custodial parent seeks to become the child’s legal parent. A second parent adoption occurs in couples where one parent is the biological parent and his/her domestic partner or spouse seeks to become the child’s legal parent. Stepparent or second parent adoptions involve obtaining consent to the adoption from the biological/other parent, a waiver of parental rights, or requesting that the court terminate the parental rights of an absent parent.
