In a recent survey of divorce lawyers, 81 percent say they have seen an increase in the use of social networking evidence (such as information from Facebook, MySpace and Twitter) during the past five years. The survey conducted by the American Academy of Matrimonial Lawyers (AAML) identified Facebook as the “unrivaled leader for online divorce evidence.” 66 percent of the survey participants cited it as a primary source.
As AAML president Marlene Eskind Moses said in the press release about the survey.
“If you publicly post any contradictions to previously made statements and promises, an estranged spouse will certainly be one of the first people to notice and make use of that evidence.”
The best advice is to stop using social networking sites if you are going through a divorce. If you can’t stay away completely, keep it professional. Assume that your spouse, or worse – their lawyer, is hanging on your every word.
